Terms and conditions

TERMS AND CONDITIONS

This terms and conditions are applicable for all package holidays made with Lanka Holidays.Net (PVT) Ltd. We are registered in Sri Lankan Tourist board under the no: SLTDA/SQA/TA/1037 License no TA/2020/0217 and the official address is No. 287-3/2, Havelock Road, Colombo 06.

Please thoroughly review these terms and conditions as it forms as the holiday contract between you and Lanka Holidays. Net. Please notice that it is your sole responsibility to inform all other parties traveling of the contents of these terms and conditions. The booking passenger, by accepting this receipt and making payment to LHN, acknowledges that they have been advised of, reviewed, and hereby accept these terms and conditions and contract for travel-related services.

GENERAL DETAILS

TRAVEL DOCUMENTS

As all the passengers (including infants) are requested to provide a valid passport with the expiry date not before at least six months from the date of departure. Make sure you confirm all documentation requirements for all passports, visa, vaccination, or other entry and/or travel requirements to avoid any damages incurred as a result of failure to comply with applicable documentation requirements.

VISAS

Any foreign national who will be visiting Sri Lanka for a short period is required to apply ETA and ensure pre-approval before the journey to avoid unnecessary delays at the port of entry and adhere to enhanced pre-clearance. Please visit https://www.eta.gov.lk for further details and to apply.  If you are applying for the visa online ensure that you make the payment by accessing to Sri Lanka ETA website. Please note that we do not accept any responsibility if you cannot travel because you have not complied with any passport, visa, or immigration requirements.

Please note we can apply for the visa which cost an extra amount for you but please makes sure you inform us at the same time, you confirm the tour.

HEALTH & VACCINATIONS

You are responsible for ensuring that any existing medical conditions or disabilities which may require the assistance are declared to us before you book your holiday or, if newly diagnosed, before your due date of departure so that we can pass these details on to relevant parties in good time. We are not in any circumstances liable if any carrier refuses you or any member of your party as a passenger as a result of any medical condition or disability. Women 28 weeks or more into pregnancy at the time of return, travel must have a doctor’s certificate confirming that they are fit to travel (note airlines normally require certification at 32 weeks). We are not liable for any costs, delays or illness resulting from your failure to meet any requirements.

Please make sure you are aware of all recommended and required vaccination before your travel. Many vaccinations required at least one month or more before the travel date to be fully effective. So, consult your GP surgery or relevant person as early as possible and ensure that vaccinations or preventative measures are taken.

CHOOSING YOUR HOLIDAY PACKAGE

You are the best aspect of our company. So, we are doing our best to compete with your satisfaction. We hope you have the best holiday with us so we want you to choose the right arrangements for you. In that case, you are welcome to speak with our experts to get their professional opinion and make changes as you wish. However, we wish you do the basic research on Sri Lankan holiday and come to us with an idea to select the correct option for you. Moreover, please keep in touch for updates on your package.

ACCOMMODATION

ACCOMMODATION AND THE CLASSIFICATIONS

As we always admire your comfort, we have done the accommodation classification as per the local authorities and our own experience. “Star” designation may vary from country to country the comments we make in our descriptions are based on our knowledge of the hotel and the feedback we have received from customers. Please note even though we have an idea about your choice of accommodation we can make no guarantee about the suitability or availability of accommodations until we confirm the reservation. If the particular accommodations sought are unavailable, we will do our best to reserve comparable accommodations, if possible.  However, if you are looking to upgrade the rooms or change the hotel to a higher star you would have to bear any additional costs. We reserve the right, for technical reasons, in cases of force majeure or actions by third parties, to replace the planned hotel with accommodation of the same category offering equivalent services.  This would only be in exceptional circumstances and such cases we will inform you as soon as we are aware of this necessity.

TYPES OF ROOM

Room classifications and amenities may vary by hotel and/or country, so it is your responsibility to check with the hotel ahead of time to verify the specific amenities offered at the time of your stay. In Sri Lanka, Many hotels maintain the international standard including the size of the room and bed. If you are concerned about such things please inform us ahead of time to find the details for you. Unless LHN makes no guarantee that its descriptions and photographs are an exact representation of the particular rooms offered.

  1. SINGLE ROOMS – Some hotels Single and Double room rates remain the same. Despite the no of people who occupy they offer double room for Single person. In some cases, the hotel might deduct the meal rate of one person when the room is occupied by a single person.
  2. DOUBLE ROOMS -Please inform us in advance if you prefer a double room or Twin Room as some hotels, not in a position to provide the required rooms. The same hotels might have the correct room type in higher categories.  Make sure you advice the correct room type at the time of confirmation and If you are planning to change the room type after the confirmation please inform us in advance to avoid the disappointments especially if you are travel in peak periods.
  3. TRIPLE/ QUAD ROOMS – when the third or fourth person sharing the room then you will have an extra bed placed in Double room. This extra bed can be a camp-bed or rollaway bed which is more suited to a child. In some hotels basic categories don’t offer extra beds, so you might have to book two rooms or a room in a higher category. 

INFANTS AND CHILDREN

In many hotels, infants (0- 2 years) and young children between 2 to 5 years can share parent’s beds with no costs. Children between 6- 12 years can share parent’s beds for free and a percentage of adult’s rates will be charged for meals. If they require an extra bed then it will be charged separately. However, these policies can be varying by the hotel and /or country. Please make sure you advise your requirement at the time of booking.

We would like to ask parents who are traveling with infants to bring with them the appropriate are e food for their child, as they may not be able to find it at some destination.  You may be asked to pay a charge, for example for provision of a cot and/or for heating baby food and drinks. You should request this when making your reservation, though we cannot confirm the availability of such services.

During the peak period and on some special occasions supplements for special meals can be added to the child’s rate.

CLIENTS WITH SPECIAL NEEDS OR DISABILITIES AND MEDICAL CONDITIONS

If you have special needs or a disability you must inform us ahead of time and verify that special needs can be met. As many premises in Sri Lanka have no special access to the least able person we need to create a special package that suits you. At the time of booking, we may request you to give us full details of your disability in writing.

MEALS

These depend on the meal plan chosen / applicable.

  • Room only – if you book your accommodation in Room only basis then no meal included during the stay.
  • Breakfast. Many accommodation providers offer continental breakfast and most of the time buffet meals will be served. Most of the accommodations do not recommend or/and accept reservations on the RO basis. So, the rooms have to book on a BB basis or above.
  • Half board.  This includes accommodation, breakfast and either dinner or lunch, but no drinks.
  • Full board.  This includes accommodation, breakfast, lunch and dinner, but no drinks.
  • All-inclusive.  This includes accommodation, breakfast, lunch, dinner, and normal drinks (mineral water, fruit juice, sodas, wines, local alcohol). Some alcoholic drinks may not be included and will be billed separately. Some hotels only offer all-inclusive packages.

In the case of full board or half board, drinks are not included, unless specifically mentioned in the description. It is necessary to comply with all relevant rules, particularly concerning the opening hours of the restaurant(s) or bar(s), and the places designated for the consumption of meals and drinks.

Supplement for special meals

On special events such as X,’ mas and New Year special meal supplements might include in the cost. In many hotels, it is compulsory and not refundable.

Special Meal requirement

In need of special meal (gluten-free, sugarless, cholesterol-free, vegetarian, etc) requirements due to medical conditions and allergies we advise you to inform us in advance. We will inform the relevant parties and keep in touch until you conclude the holiday with us. However, we also advise you to be alert and keep negotiating with hoteliers and restaurant workers as we held no responsibility for any circumstance such as allergies and medical conditions occurred.

CHECK-IN / CHECK OUT

Check-in and check out often vary by hotel, so please check with the hotel ahead of time to verify the relevant policies and times.  LHN is not responsible for any charges and damages resulting from your failure to timely take possession or vacate your room.

EARLY ARRIVAL OR LATE DEPARTURE

If you require to arrive early or leave the hotel later than normal time plan then you will be charged an extra night price or lesser than that. Depends on the availability and / or special cases you will be able to use the room for extra hours for free but you must advise us in advance to negotiate with the hotel, however, sometimes we can’t guarantee the rooms as this are solely decided by the hotelier and they only offer the rooms on availability.

HONEYMOON / ANNIVERSARY OFFERS

Make sure to advise above at the time of booking to get the best discounts and benefits. You may have to produce a copy of the marriage certificate and take it with you on your holiday. In case if the certificate not produced or failed to prove then the normal rates will be charged for the stay

MINIMUM LENGTH OF STAY AND CHECK OUT ON 31STDEC

 During peak periods some hotels have set the minimum length of stay requirement, the night spent at the hotel must be consecutive. Check out on 31stDec will be not allowed in some hotels. If you are traveling during this period then please check with our representative.

TOUR/ ACTIVITIES/ EVENTS

GENERAL HEALTH REQUIREMENT

Before you confirm the tour make sure that the selected tour is suitable for you as many of our tours required a good level of fitness to cover. We would recommend for you to contact our expert assistance to tailor-made the tour for you if you have any disability or have any reduced mobility. Also, we recommend having an able-bodied carer to assist you throughout the tour.

ACTIVITIES OFFERED DURING YOUR STAY

Some activities may not be appropriate for all ages or individuals with certain medical conditions.  We advise you to take relevant measurements and do the demonstration if possible before involving in such activities. LHN may not be held liable in the event of an incident or accident which is due to a lack of vigilance on your part.

Certain activities (whale watching, hot air ballooning, etc) included in the itinerary may be no longer carry out by our local provider due to climate reasons or any other unpredictable reasons. In such circumstances Depend on the situation we will try our best to do suitable action such as an amendment. However, please note we are not responsible for any uncontrollable situation or the sudden changes happen due to reasons listed above.

The sports activities offered for collective participation is often organized by outside providers. If activities canceled at short notice or subject to the minimum no of participants you will receive the full refund you paid for the certain excursion or activity. 

Some facilities like the swimming pool, some restaurants, may not be available during the off-peak seasons or due to the maintenance process. In such a situation Hotel management is making the decisions and we are not liable for any circumstances.

Some activities not listed in the confirmed itinerary can be done and we can offer assistance and also act as a booking agent for you. Any travel costs related to such activities are at the customer’s expense.  Similarly, these activities may be withdrawn at the discretion of the organizer if there is insufficient demand.  This will not give rise to any entitlement to compensation. Moreover, LHN is not responsible for any events that occurred, breach of contract, or negligent act of activity provider.

YOU ACKNOWLEDGE THAT THE USE OR ENJOYMENT OF AN ACTIVITY MAY BE HAZARDOUS AND INHERENTLY RISKY, AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, LHN SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURY OR DEATH; LOST, STOLEN, DAMAGED OR DESTROYED PROPERTY; OR OTHER LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE USE AND OPERATION OF THE ACTIVITY, AND ALL ACTIONS OR EVENTS OCCURRING before, DURING, AT OR AFTER, THE ACTIVITY.

PUBLIC HOLIDAYS/ FESTIVALS / EVENTS

Religious, cultural festivals and events take place throughout the year in Sri Lanka and these festivals may disrupt your holiday as a result of some restrictions or reduction of facilities and entertainment. We advise you to do the research and find out about those upcoming festivals during your stay and plan ahead.

HOLIDAY SEASONS

Even though you can travel all around Sri Lanka throughout the year, you will be not doing some seasonal activities and excursions such as whale watching, game driving. However, you will be able to take advantage of quiet beaches, the least waiting queue for excursions. Please be noticed that some hotels might reduce the scale of some features such as pool or clubs.

TRAVELING WITH CHILDREN

Car seats are not compulsory in Sri Lanka. Still, we advise you to bring your child’s seats for the sake of your child’s comfort or Contact us in advance if you want us to arrange a seat for you. If we asked to arrange a car seat for you then there may be an additional charge for it.

EXCURSIONS / TOURS

We delighted to mention that we always arrange private tours for our clients except for a few excursions such as whale watching.  Safarijeeps and boats only allow 6 people maximum in one ride. If the group is bigger than 6 pax then we will arrange required no of jeeps or boats for the whole group but they might not able to do the excursion at the same time. As we have to make the arrangements in advance for such excursions and tours last-minute cancellations from your side won’t accept and no refund will be given. Also please beware the cost of any unused tours in the itinerary may not be refunded.

Some excursions require a long trip on the road and early starts. If you are not willing to compromise then you can change the time in advance once you negotiate with our guide or representative but the best experience cannot be guaranteed. 

CONFIRMING THE HOLIDAY

Once you choose the most suitable package or tailor for you, to secure all the arrangements you are advised to confirm the package in written once we received the written confirmation we secure all arrangements and please note at this time we reserve the right to increase or decrease and correct any errors and to change any information. Once you receive our confirmation along with confirmed itinerary we advise you to go through the details and to pay the US $ 250 or 25% of your total holiday cost, whichever the higher. Once we receive the Payment we assume that you understand and have accepted the terms and conditions. You can make modifications to your arrangements after the confirmation, but please note some certain changes such as changing hotels and changing some excursions may affect the price agreed. We reserve the right to refuse to accept any booking without necessarily specifying a reason. If you wish to cancel the arrangements the deposit will only be refundable as per these booking conditions. Cancellation guidelines have given separately.

BOOKING ACCURACY/LEGAL NAMES

You are required to review all the details of your reservation including passenger Names, mailing address, email address, telephone number, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking receipt. Make sure you inform us immediately if any omissions and/or corrections are needed regarding the booking details. In case of failure to report such errors and/or omissions, you will be full &sole responsible for any risks and/or costs involved with. Also, you are requested to provide legal first and last names as they appear on booking and travel documents to make the reservation at hotels as names must be identical.

PAYMENTS

In our confirmation, we have indicated a ‘payment due date’.  We hold reservations until this payment due date and if the deposit/ payment is not received by then reservations are automatically canceled. We advise you to contact us immediately in advance if you are unable to meet this obligation as a failure to remit payments on a timely basis will automatically put your booking at risk of cancellation.

We accept various methods of payment. Please contact us for further details. The payment can be done online or/and we can make arrangements to collect the payment once you arrive here. However, if you wish to make the payment once you arrive, and then we may require a fair amount as a deposit. This deposit may vary depending on the hotels you reserve and the time you travel. During the peak season, we might require you to make the payment in full before you arrive. Collecting payment locally is us to decide. Please note we have authorized not to continue the tour or proceed with arrangements if we do not receive the payment as agreed. Without limitation, you voluntarily hold LHN harmless for cancellation of any booking for either late payment or declination of a credit card.

PRICING

 Prices and availability quoted by LHN are not guaranteed until the deposit is fully paid. Pricing and availability may change without notice. We are not responsible for any errors or omissions in any quotes, advertisements including on our website, resulting in inventory, content, or pricing discrepancies nor is LHN responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold LHN harmless for any actions or damages arising from Supplier pricing.

In our confirmed itinerary, we have mentioned includes and excludes. We advise you to go through those details when you make the payment. accommodation as mentioned In the itinerary, transport as per the itinerary, meals as per itinerary, all government taxes, guide/ driver service, sightseeing and entrance fees unless otherwise stated are the general includes in our packages.

Unless otherwise stated your package does not include Visa fees, Airfare, tips, meals not included in the itinerary and excursions and activities in addition to the confirmed tour.

We reserve the right to charge for any increase in taxes, fees, or surcharges (i.e. fuel). You acknowledge this right and agree to pay any such additional taxes, fees, and surcharge.

PRICING ERROR

Even though we are doing our best to be more accurate and be updated up to date regarding the hotel rates or tour excursions or government rules pricing errors can be occurred due to unpredictable reasons. In case of such errors, we will do our best to solve the matter locally but in some cases, we might ask you to decide to pay the addition or else to make amendments to the itinerary to match the previous price. If you do not accept the price or offered alternatives we reserve the right to cancel the booking.

MAKING AMENDMENTS

If you wish to make amendments to your confirmed itinerary then the leading person who made the booking has to inform us it in writing. Once we received the request we will do the negotiations with the relevant parties and inform you of the possibility. These changes might require an additional charge towards the final cost as well as an administration charge. Changing the arrangements in a lower value than the original value is not possible all the time. if we agreed you can proceed with the holiday of lower value and then if you cancel the booking we reserve the right to charge the cancellations on the original value.

TRANSFERRING BOOKING

If you are planning to transfer the booking to another person, please make sure that the person is aware and agrees to all the terms and conditions. Such change has to make in writing and at least 3 days before the tour start. During the peak period, you are requested to make changes at least 30 days before to avoid any additional charges. Please be aware, these changes not acceptable by some hotels and they will charge cancellations as per the cancellation policy. You might have to pay an administrative cost for such changes and we will inform the cost at the time of booking. 

INSURANCE

You must be fully insured for your holiday and must make sure that all of the activities which you will be carrying out are covered by such insurance. This insurance must include adequate cancellation insurance to the value of your holiday, emergency evacuation, and repatriation costs in respect of all of your activities. Please note that the travel insurance provided by some credit card providers often only offers the minimum coverage and, whoever your insurer, you should always check for any exclusion of activities that you might be undertaking. In response to public concern, some insurers now offer specific insurance against cancellation, delay, and abandonment due to volcanic ash disruption. This can be taken out as an add-on to some travel insurance policies or as stand-alone cover.

CANCELLATION POLICIES 

All cancellations or no-shows are subject to penalties as per the below policy. Additionally, all booking cancellations or no-shows are considered cancellations and subject to a non-refundable $50 per person fee imposed by LHN. 

All cancellations MUST be in writing and send via email by the leading person who made the booking. Cancellations received before 5.00 pm local time will take effect from the same date and if we receive the cancellation after 5.00 pm local time then the cancellation will take effect from the next day. You will receive a cancellation invoice once we proceed with the cancellation. Usually, this takes 3 days and if you do not receive the cancellation invoice within 3 days we advise you to contact us immediately to avoid the increase in charges.

Amendment charges and administrative fees are not refundable.

Cancellation charges as below;

Prior 61 days              – 10% of the total value

Between 60- 30 days before arrival – 50% of the total value

Between 30 -15 days before arrival – 75% of the total value

Between 15- 0 days and no shows – 100% of the total value

AFTER YOU ARRIVE SRI LANKA

FLIGHT DELAYS

We understand that flights can be delayed for many reasons. In case if you can inform us in advance about the flight being delayed, then we can rearrange the transfers and accommodations accordingly. As a responsible tour operator, we will do our best to re-arrange the transfers and/ or required services when flight delays without further notice.  However additional charge may be added to your tour cost and no refunds will be given for not used accommodations, meals, and transfers.

LUGGAGE

Please note we are not responsible for additional luggage you bring other than appropriate no of luggage which normally weighs no more than 45kg. The vehicle we provide usually fits no of pax in your party and their luggage’. However, if we notice that you are caring too many bags that’s make others uncomfortable we might advise you to leave them in the airport luggage counter or in the hotels you accommodate first ( for security reasons some hotels do not accept this. So please check in advance) until you collect them on your departure trip. You might require paying the additional cost for these services provided by airports and hotels. Also if we have to go extra miles to collect this luggage during the departure transfer you might have to pay for extra miles.

PERSONAL BELONGINGS

We advise you not to bring many valuables while on holiday and if you bring any please keep them in your hand luggage all the time. Please note it is your responsibility to keep safe your belongings. If any valuables are lost or stolen you can report to the relevant parties such as hotel management or make a complaint at the nearest police station.

WATERSPORTS AND OTHER ACTIVITIES

Before you proceed with any activity or sports we advise you to check with the responsible person and demonstrate your ability to do such sports. We value your safety all the time so we or our partners or suppliers have rights to cancel any sports or activity that put yours or other’s safety at risk.

Water sports and other activities may offer by many hotels free of charge or for an additional cost. We advise you to take appropriate measurements and research on such events provided by hotels or other suppliers.  there may be certain age restrictions and require a good level of physical fitness to participate in such events. We do not reserve any liability for activities and sports arranged between you and the third party.

BEHAVIOR

You are responsible for your behavior and that of your party. We and our suppliers reserve the right to refuse your booking or the right to remove you and/or any member of your party from any transport, accommodation or any part of your holiday if you or any member of your party is drunk or under the influence of drink or drugs; if we reasonably believe that you are in unlawful possession of drugs, or are behaving violently, disruptively, dangerously or irresponsibly or in any manner whatsoever which presents a risk to you or others or is causing a nuisance or annoyance to others or causing damage to property; No refund will be given, or compensation paid, and no costs or expenses for which you become liable or which are incurred by you will be made by us or be recoverable by you from us in such circumstances.

You may also become the subject of police inquiry or security measures or investigation and liable if any offense is committed to criminal prosecution and penalties. You must fully cooperate with and follow any safety procedures and instructions given by any organization which is running the activities which you do while on holiday. Such organizations may require you to sign a waiver form in respect of the activity being carried out.

EXCURSIONS

Excursions and additional tours can be arranged whilst on your holidays but it will charge an additional cost. Talk to our expert or inform our driver/ guide to re-arrange things for you. If additional excursions affect the original plans then we might ask you to decide the suitable option. In case if you wish to cancel the original plan and we cannot make the refund for activities already being arranged for you.

COMPLAINTS

You can have a complaint regarding the service and accommodation or any other aspect we advise you to contact us on emergency contact no or email without undue delay. At the same time, you must inform the relevant supplier whose service is involved. We will endeavor to put things right within our capacity. 

If you wish to make a complaint after you return from your holiday then we advise you to give us full details in written within 30 days of your holiday. However, we advise you to report the complaint whilst on holiday to get the fair opportunity to investigate and rectify.

the conditions in accommodation and services may vary enormously when compare with your home country, and the people we deal with on the ground may be less time-conscious or meticulous in planning than ourselves, and while we will do our best to ensure that the the holiday goes according to plan, we ask that those who travel with us do so with a spirit of adventure, in a positive frame of mind, and good humor.

REFUND

In circumstances beyond our control; if we are to cancel your holiday or make changes to arrangements due to unavoidable and uncontrollable circumstances then we cannot accept any liability or pay any compensation. 

While we are in urge to provide the best service and to find top quality Suppliers, no undertaking, guarantee or warranty is given or shall be implied as to the fitness or condition of the Supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied. In some cases, we might able to require a refund behalf of you and if the supplier agrees we may proceed with the refund. To make such request you are advised to give us full details with prof. You are advised to  acknowledge and agree that we shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier we are not liable for any accident which occurs in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, onboard a cruise ship, on tenders, on shore excursions, or during any mode of transportation encountered during the the trip, resulting from equipment or any other cause. We require your full understanding of the nature and character of the mode of transport and assume all risks of travel, transportation, and handling of passengers and baggage.

LIMITATION OF LIABILITY

Without limitation, we require you to assume the risk of, and agree that we are not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at the commencement of the trip, desertion or revolt of the crew, or lost/damaged/delayed luggage.

MODIFICATION OF TERMS AND CONDITIONS

 The Terms and Conditions may be required to amended or modified without any prior notice.  Therefore please be aware of updates we make time to time and also make sure you go through terms and conditions each time you make a booking with us.

Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with LHN.  Without this acceptance, any order is subject to cancellation at any time.
